回覆:
1:你朋友是少年,非犯最輕本刑三年已上之重罪不會羈押,也非地檢檢察官偵查的範疇
而是少年法庭法官偵審的!
2:盜領家人的錢是侵占和沩文(存摺是私文書)屬想像競合犯----刑法55條一行為觸犯數罪!
3:親屬間竊盜和侵占屬告訴乃論之罪-----找親屬(被害人)和解,連儰文一併和解,並寫張悔過書附上少庭
4:不會收押也不用交保金
5:可能判假日生活輔導(學生)或保護管束,不會判刑(未達少年事件處理法的犯行標準)
6:但有前案記錄(非前科),過一段時間可塗消記錄
7:希望重新做人不要再犯,否則滿18歲就要負完全責認喔----入監服刑
